The member of Parliament Soi County Hon Chemaswet Kisos and Hon Chelangat Solomon Aling’a, Member of Parliament T’oo County have both withdrawn their signatures from censuring the 4 Parliamentary Commissioners over alleged corruption.
In a letter seen by this publication dated 20th August 2024, addressed to the speaker of Parliament, ,Hon Anita Among ,thetwo members of Parliament, they have decided to withdraw their signatures following the high Court’s ruling on the issue.
Chemaswet and Ling’a noted that, at the time they signed the motion, they were not aware that the issue had been taken to court by an aggrieved member of the public.
The dual in a joint written letter stated that they only came to know the ruling of the matter by the high Court on 12th August 2024 and they would like not to go against the Court’s ruling.
“Nonetheless, Rt. Hon. Speaker; this is to draw your attention to page.3 and page.4 of our motion as presented to the Clerk to Parliament on 5th August, 2024. It raises other grave matters of Misconduct, misbehavior.
In the final analysis therefore, we once again reiterate our position as Petitioners that the Parliament shall not be turned into a Court of Law or Judicial body, hence the principles of res judicata as raised in your letter cannot arise”, read part of the letter.
Further, the two Mps noted that, Hon, Theodore Ssekikubo on Thursday, 15th August, 2024 while appearing on NBS TV Talk show Programme titled “Fourth Estate” raised very many other issues like Commissioners traveling abroad with their spouses, award of contracts for Institutional procurements etc, which were not part and parcel of the issues in the Motion they appended their signatures to facilitate its filing with the Clerk to Parliament on the 5th August 2024.
“Rt Hon. Speaker, the addition of issues by the Movers of the Motion to the original motion amounts to an illegal amendment of the motion, which in itself amounts to a departure from the earlier issue of ‘Service award’ which we had agreed to and was aggrieved about. This action clearly shows that, the Movers of the Motion intend to illegally use our signatures to achieve their own strange ambitions without our express consent especially because, the purpose for which, we appended our signatures has already been put in perspective and as such extinguished by the said High Court of Uganda decision”, read another part.
The two Mps went on to say that if the movers of the Motion want to address additional issues outside the motion they ought to seek fresh mandate in respect to the amendments by acquiring new signatures to back the amendments to the motion, which they have not done.
The duo this to them amounts to fraud, misrepresentation and abuse of their signatures by the movers of the Motion.
“Rt. Hon. Speaker, in light of your guidance in respect to the motion and the court decision in the High Court Misc. Cause No.85 of 2024; Bwette Daniel-Vs- The Parliamentary Commission and the fact that, there is a departure from the Original Motion over the ‘Service Award’ received by the Four Commissioners of Parliament, we hereby withdraw our signatures and therefore consent from the saidvMotion filed with the Clerk to Parliament by Hon. Theodore Ssekikubo on the 5th August, 2024, for the above reasons,” added the Mps.
