Sipi Town Council Denies Knowledge of Kitale SS School Handover, Accuses Cooperative of Forging AGM Minutes

KAPCHORWA — The Sipi Town Council has denied formal knowledge of the handover of Kital Secondary School by the Farmers of Kapkwirwok Growers Cooperative Society Ltd, was slated for Saturday 01 February 2025, citing procedural lapses and allegations of forged Annual General Meeting (AGM) minutes.

In a letter dated January 28, 2025, addressed to the Chairperson of the Kapkwirwok Growers Cooperative Society Ltd, Town Clerk Butala Robert acknowledged receipt of the society’s request regarding the transfer of Kital Secondary School. However, he emphasized that crucial legal and procedural steps, as outlined in the Cooperative Act 107 and the Cooperative Regulation of 1992, have not yet been fulfilled.

Among the key requirements yet to be met are:

A resolution for the transfer of ownership approved by at least two-thirds of fully paid members during a properly convened AGM.

Authentic minutes of the AGM, signed by attendees with their National Identification Numbers (NIN).

Proof of ownership of the land and school.

Documents showing the school’s affiliation with the Sebei Cooperative Union.

Submission of the transfer resolution to the Registrar of Cooperative Societies within 14 days after the AGM for official registration and approval.

Forgery Allegations

Further complicating the matter, the cooperative society is now facing accusations of forging the AGM minutes related to the handover. Town Council officials have raised concerns that the documentation submitted may not be genuine, casting doubt on the legitimacy of the transfer process.

“We cannot accept any handover based on forged or improperly documented AGM minutes,” a council official stated. “The integrity of this process is crucial to ensuring lawful and transparent governance.”

The Town Council has reiterated its commitment to ensuring that all legal requirements are met before any official transfer takes place.

    Members let’s be people who reason now I thank the leadership of Sipi town council for refusing to accept the forced hand over and the one handing over is someone who knows all about law so to me the members of the co-operative society were comprised basing on clanical matters and if this school is to be handed over then proper documentation should be followed thanks I beg to lay my submission
